These terms govern your use of the Gymswell app and website, published by IdeaPlaces Inc. By creating an account or using the app, you agree to them. If you do not agree, do not use Gymswell.
Gymswell is not medical advice. It is a training and nutrition tracking tool, and the guidance it generates is produced automatically. It is not a substitute for a physician, a dietitian, or a qualified coach. Talk to a professional before starting a new training or nutrition program, and stop and seek help if something hurts.
You must be at least 13 years old. If you are under the age of majority where you live, you may use Gymswell only with the involvement of a parent or guardian. You are responsible for keeping your account credentials secure and for activity that happens under your account.
Strength training carries risk of injury. Gymswell suggests exercises, loads, sets and rest periods based on the history you record and on general training principles. It cannot see your form, your injuries, your medical history or your equipment. You decide what you lift.
Calorie and macronutrient figures, including those estimated from a photograph of a meal, are approximations drawn from public food databases and automated analysis. Treat them as estimates, not measurements, and do not rely on them for any medical or clinical purpose.
You use Gymswell at your own risk. Consult a physician before beginning any exercise or nutrition program, particularly if you have a medical condition, are pregnant, or are recovering from an injury.
Health information. If you connect Apple Health, Gymswell reads your weigh-ins and cardio workouts to keep your trend weight, calorie target and training log current. Gymswell does not diagnose, treat or monitor any medical condition, and nothing it shows from your health data is a medical assessment.
The workouts, logs, photos, notes and measurements you put into Gymswell remain yours. You grant IdeaPlaces Inc. the limited licence needed to store, process and display that content back to you, and to operate the features you use, including sending the relevant parts of it to the AI service described in our Privacy Policy. We do not claim ownership of your content and we do not use it to advertise to you.
You are responsible for the content you upload, and you agree not to upload anything unlawful or anything you do not have the right to use.
Do not use Gymswell to break the law, to interfere with or overload the service, to attempt to gain unauthorised access to any account or system, to reverse engineer the app except where that right cannot lawfully be restricted, or to scrape or resell its content or data.
Gymswell, including its software, design, exercise library, videos and text, is owned by IdeaPlaces Inc. and protected by copyright and other laws. You get a personal, non-transferable, non-exclusive licence to use the app on devices you own or control, for your own use. Nothing here transfers ownership of anything.
Gymswell is free to use. The free plan includes logging, your history and the Dashboard, and 10 AI actions per day (an AI action is one request to the coach, the workout generator or the meal estimator).
Gymswell Pro is an optional auto-renewing subscription, offered as Pro Monthly and Pro Annual, that removes the daily AI limit. The price and the length of each period are shown in the app before you buy.
Your use of the app is also governed by Apple's Standard Licensed Application End User License Agreement (EULA). Where it and these terms differ, these terms add to it and do not take away any right it gives you.
We may add, change or remove features, and we may suspend or discontinue the service. We will give reasonable notice of a discontinuation where we can. We do not guarantee uninterrupted or error-free operation, and some features depend on third-party services that can themselves fail.
You may stop using Gymswell and delete your account at any time in the app, under Profile › Account › Delete account. We may suspend or terminate an account that breaks these terms or that we reasonably believe is being used to harm the service or other users.
To the fullest extent permitted by law, Gymswell is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, IdeaPlaces Inc. is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or lost profits, arising from your use of Gymswell. Where liability cannot be excluded, it is limited to the greater of the amount you paid us for Gymswell in the twelve months before the claim, or fifty Canadian dollars.
Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Gymswell is distributed through the App Store. Apple is not a party to these terms and has no obligation to provide support for the app. These terms are between you and IdeaPlaces Inc. Apple is a third-party beneficiary of these terms and may enforce them against you.
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there, without regard to conflict of law rules. The courts of Quebec have jurisdiction, except where your local consumer law gives you the right to bring a claim where you live.
If we change these terms we will update the effective date above, and material changes will be communicated in the app. Continuing to use Gymswell after a change means you accept the updated terms.
